From Ashes to Assets

From Ashes to Assets

This case study examines the strategic subrogation management led by BARBUSS following a large-scale fire at one of the largest ports in the Andean region. Facing a total loss of cargo destined for 70+ countries, the intervention focused on deconstructing “Act of God” defenses through technical evidence and IMDG Code violations. The result was the establishment of strict liability for the port operator and a high-efficiency financial recovery.

A global corporation with operations in over 70 countries utilized this port as its primary logistics hub for Latin America. A catastrophic fire decimated several warehouses, resulting in a 100% total loss of inventory intended for the entire region.

Following the adjustment of the loss, the insurer indemnified the policyholder for a sum exceeding USD 8,000,000.00. BARBUSS was retained from the onset of the adjustment process to analyze the nature of the claim and determine the viability of subrogation proceedings against the port operator, who held legal custody of the goods at the time of the occurrence.

STRATEGY APPLIED

The cornerstone of BARBUSS’s success was not merely a formal demand, but a deep-dive technical investigation designed to dismantle the counterparty’s legal defenses. The strategy focused on three pillars:

1. Origin and Cause Identification: Forensic mapping proved the fire did not originate within the insured’s designated area, but rather in a cargo consolidation zone managed exclusively by the port.

2. Technical Causality Analysis: The investigation identified an exothermic reaction caused by the improper mixing of incompatible chemical substances.

3. Operational Negligence & IMDG Compliance: Evidence revealed a breach of the International Maritime Dangerous Goods (IMDG) Code, specifically regarding mandatory segregation distances for hazardous materials.

DEVELOPMENT

By reconstructing the chain of events, BARBUSS successfully framed the case under the Strict Liability doctrine for dangerous activities. This legal framework shifted the burden of proof to the port operator. The robustness of the technical evidence rendered the “unforeseeable event” (Force Majeure) defense ineffective, as the fire was shown to be a preventable consequence of regulatory non-compliance.

CHALLENGES AND CLIENT MANAGEMENT

The primary challenge was the scale of the destruction; in catastrophic fires, physical evidence is often compromised. Furthermore, overcoming the legal barrier of Force Majeure in port operations requires a high threshold of proof.

BARBUSS managed the client’s expectations by providing a transparent risk-benefit analysis of litigation versus settlement. By presenting a “bulletproof” technical file to the port’s legal team, we demonstrated that a court battle would be futile for them, thereby accelerating the recovery timeline.

CONCLUSION

The intervention of BARBUSS transformed a complex recovery scenario into a benchmark of efficiency. By leveraging technical precision over protracted legal disputes, we achieved a pre-litigation settlement that significantly exceeded the usual recovery expectations. This case proves that in the face of catastrophic loss, specialized technical-legal expertise is the most effective tool for maximizing financial recovery.

Senior Claims Handler
